STATEMENT OF ABS-CBN ON OSG’S QUO WARRANTO PETITION: WE DID NOT VIOLATE THE LAW
 
The Office of the Solicitor General’s filing of a quo warranto case against ABS-CBN on alleged violations of its franchise appears to be an effort to shut down ABS-CBN to the serious prejudice of millions of Filipinos who rely on the network for news, entertainment and public service.
 
These allegations cited by the Office of the Solicitor General in his press statement are without merit. ABS-CBN complies with all pertinent laws governing its franchise and has secured all necessary government and regulatory approvals for its business operations.
 
(1)    All our broadcast offerings, including KBO, have received the necessary government and regulatory approvals and are not prohibited by our franchise. 
 
(2)    ABS-CBN Holdings’ Philippine Deposit Receipts or PDRs were evaluated and approved by the Securities and Exchange Commission and the Philippine Stock Exchange prior to its public offering. These are the same instruments used by other broadcast companies to raise capital for the improvement of services.
 
(3)    The ownership of ABS-CBN in ABS-CBN Convergence was undertaken under the same law and structures that have been utilized by other telecommunications companies. These are transfers that are approved under the Public Telecommunications Policy Act and are fully compliant with law. 
 
We reiterate that everything we do is in accordance with the law. We did not violate the law. This case appears to be an attempt to deprive Filipinos of the services of ABS-CBN. 
KBO remains one of the cheapest forms of entertainment that we can provide to the public. The capital we have raised from the PDRs has enabled us to provide services to nearly 90 percent of the Philippines and to our OFW’s all over the world. Our work with ABS-CBN Convergence supports the government policy of finding ways to bring down the cost of internet access.
 
The Senate, the House of Representatives, and the Executive Branch have assured the public that our franchise will be allowed to go through the proper renewal process in a fair manner. To that end, the filing of the quo warranto case is ill-timed given that Congress has already resumed its session.
 
We remain committed to our mission to serve the Filipino people especially at this time when millions of Filipinos rely on our services in delivering information such as the 2019 NCoV ARD, the developments in the Middle East, and updates on Taal Volcano situation as they relate to our countrymen.

If ABS-CBN is compliant with the requirements of the law, then it should open its doors for any legal scrutiny. I believe Digong simply does not want 'Probinsiyano.'  so the key is to end the show and Digong will withdraw the case.  ;D

If you will just objectively open your eyes to what is happening to this country, you would know that it doesn't matter if you comply and follow the law to the letter. Kapag napagtrip-an ka ni Duterte, Calida et.al, may kalalagyan ka. At kahit pa maswertihan mo makalusot sa mga kasong isasampa laban sayo, alam mo talo ka sa gastos, oras at perwisyong pagdadaanan mo. Samantalang si Calida eh di naman nya pera ginagastos sa pagsampa ng mga kaso!

Same can be said of Duterte's SALN.  If it's compliant with the requirements of the law, then it should open its doors for any legal scrutiny.  So why hide it?

Correct! So better file the case just like what Calida did and let the court answer the legal question.

I wonder which law you are talking about that permits the Sol Gen to cancel franchises?

How is it any better? Kasi dinaan sa legal na proseso? You are the government and you are using the full force of the law for personal vendetta. Di naman ganyan ang intention ng batas natin. We all know this is a no-win situation for ABS CBN and it's a win-win situation for Calida for reasons I stated above.

Parang yung kay Sereno lang. Since hawak ni Duterte ang SC I would expect it to rule in favor of the government.

Marami ako nababasa na dapat daw magbayad ng tax ang abs. Pero wala naman ako nababasa na nagsampa ng kaso ang BIR against abs. Kaya eto na naman si quo waranto, na biglang applicable na lang sa lahat.

Let the court decide. Its better to go through the system, and that is if you believe in it. If you dont then nobody should question your thoughts.

The govt is a juridical entity. It can sue and itself be sued.

Isn't Calida requesting the Supreme Court to revoke the franchise of ABS CBN via quo warranto?

So what's that law that permits Calida to request the Supreme Court of the same?

I was thinking the same when they uaed this quo warranto to expel Sereno. Tingin ko magkaiba ang kahihinatnan ng paggamit ni Calida ngayon kasi most magistrates wanted her out in the beginning due to her qualifications. May personal reasons ang karamihan sa kanila kaya talo si Sereno. They didn’t look at the merits kasi na single out talaga sya. Obvious naman eh, hindi mo kailangang maging abugado pa para makita ang galaw ng mga yan. Halatang halata naman eh tapos playing to Duterte’s audience ang karamihan sa SC.

Natawa ako, nagpalabas na ang ABS-CBN ng ads appealing to the viewer’s sympathy. I want to see how it goes in the coming daya till expiration. Mas masaya kasi maraming solons at senators na umepal at kampi sa network. Magkakasubukan na tapos pag talo ulit ang DDS hugas kamay ang palasyo na walang nangyari.

Hindi kikilos ang solicitor general na walang direktiba ng palasyo. Yan ang papel ng OSG bukod pa sa DOJ. Matigas ang mukha nyang si Calida kahit pa matalo.

Why would you deny if indeed ABS CBN is "appealing to all for support"?  Hindi ba they are saying nga this quo warranto is akin to denial of freedom of speech?  So if you want them to stop appealing to all for support, isn't that a denial of the freedom of speech thereby proving they are correct?

Who denies? It is just an opinion. An appeal for political support, somehow diminishes its position of strength. If ABS CBN  believe they have not done any wrong, they can as well simply laugh it off because in finality the court can see that. This is how I see this.

Then I would respect that opinion. But would that opinion be equally applied as well to Duterte?  Duterte's appeal for political support also diminishes his position of strength?  Like for example always justifying  anything related to China.

Just saw in the news, 1day after mag file si Calida sa SC. Tinalakay agad sa en banc yung kaso, SC is now giving abs 10 days to respond. Sa dami ng pending cases sa SC ambilis kapag si duterte nagsabi. Parang wala na talagang separation of powers.

Ang bilis di ba?  Samantala yun petition if the president can unilaterally cancel our ICC treaty membership naka pending pa rin sa SC. June 2018 pa yata yun.

Wala naman kasi 11k employees affected doon sa ICC. Normally, urgent yung may affected na filipinos sa tingin ko.

buti sana kung yung 11k employees ang pinaglalaban ng government, kaso hindi eh, sila nagpapatanggal dun sa 11k kapag wala ng abs.

yes it would hurt the lopez/owners but it will be devastating sa mga rank and file employees nila. tapos yung government wala naman gagawin para matulungan yun.
