No, medyo matagal pa ang hold departure order ("HDO"). Baka abutin ng 1 month.

The DOJ has to file a motion with the court, tapos may hearing pa yan. The applicant for HDO has to convince the court that the accused is likey to flee. Siyempre, the accused will oppose it, sasabihin wala namang basis para sabihin na magtatago siya abroad.

Hindi rin ako sure, kasi nga mga imbento lang ng DOJ ang WLO and LBO. Ang alam ko, iba ang LBO sa WLO.

They can detain using a WLO, parang HDO. So kung ganon, ano pala ang difference ng HDO sa WLO? Ewan, pareho lang yata.

Ang malinaw, they cannot detain with an LBO. At bawal nang mag-issue ng HDO and WLO ang DOJ.

Magandang tanong. Hindi masyadong alam ng mga non-lawyers yan, pero importanteng provision ng criminal law.

Nasa Revised Penal Code, Art. 267, madali lang namang intindihin:

Art. 267. Kidnapping and serious illegal detention. — Any private individual who shall kidnap or detain another, or in any other manner deprive him of his liberty, shall suffer the penalty of reclusion perpetua to death:

1. If the kidnapping or detention shall have lasted more than five days.
2. If it shall have been committed simulating public authority.
3. If any serious physical injuries shall have been inflicted upon the person kidnapped or detained; or if threats to kill him shall have been made.
4. If the person kidnapped or detained shall be a minor, female or a public officer.

The penalty shall be death where the kidnapping or detention was committed for the purpose of extorting ransom from the victim or any other person, even if none of the circumstances above-mentioned were present in the commission of the offense.

Notes:

- Lawyers call it "Serious Illegal Detention," not just "Illegal Detention," kasi may Serious Illegal Detention at may Slight Illegal Detention.

- How long ang detention? Under paragraph 1, pag more than 5 days ang period of detention, serious illegal detention na.

- But if any of the circumstances under the succeding paragraphs is present, serious illegal detention kahit less than 5 days detention.

- For example, if the victim is a female, hindi kailangan 5 days. Sandaling detention lang, serious illegal detention na, because of paragraph 4.

- Sa kaso ni Vhong, saan nangyari ang serious illegal detention? Simula sa loob ng condo hanggang makarating ng presinto. As long as Vhong was not free to go where he wanted to go, considered "detained" siya.

- Walang 5 days ang detention niya, bakit serious illegal detention? Because of paragraph 3 --- kasi may serious physical injuries.

- Bakit no bail? Kasi non-bailable pag ang penalty ay reclusion perpetua or higher. Ano penalty? Reclusion perpetua to death (wala na tayong death penalty, so reclusion perpetua lang). Kaya non-bailable.

- Ganyang kabigat talaga ang kasong Serious Illegal Detention. Talo pa ang homicide, punishable by reclusion temporal and bailable. Baka natauhan na ngayon si Cedric at nawala ang yabang.

Ayun! Maraming salamat Atty. for the crystal clear explanation re illegal detention. As per my Immigration friends, pareho lang daw ang LBO at WLO, iniba lang talaga ang terminology. Ang mangyayari lang kapag nasa LBO at dumaan sa Immigration, they will be turned over to the PNP due to the warrant of arrest (assuming meron na), otherwise clearance from DOJ similar to GMA's case when she tried to leave.

We all know that Cedric will not go through the normal route in case he decides to leave. Bata ni Chavit yan, eh si Chavit may sariling eroplano. Yun nga magkapatid na mayor ba yun from the south na murder ang kaso nakaalis, sa labas ng airport tinatakan ang passport.

Yan ang example ng topic ng sinasabi kong dapat required sa lahat ng college courses.

Ang rule ay 12, 18 and 36 hours, depende sa imposable penalty ng krimen na inaakusa sa detainee.

Pag inaresto nang walang charges, it means warrantless arrest ang nangyari. The arresting officer must deliver the detainee to the fiscal for inquest proceedings before the maximum periods expire. Otherwise, the officer commits the crime of "Delay in the Delivery of Detained Persons."

Ibang crime yon, hindi illegal detention ang tawag.

No, hindi puwedeng pareho lang ang LBO (Lookout) sa WLO (Watch list). Hindi rin nila naiintindihan, nanghuhula lang sila.

Kung may LBO na naka-issue, at sabi nila kailangan ng clearance sa DOJ bago makaalis, e di hold departure din yon. Bakit? Paano pag ayaw kang bigyan ng clearance ng DOJ, e di hindi ka rin makaalis, hold departure din ang nangyari sa yo.

Ang HDO, puwedeng pumigil ng departure, kasi "hold departure" nga ang tawag. Pero ang WLO, puwede bang pumigil ng departure kung "watch list" lang ang pangalan? Puwede, kasi ginagawa ng DOJ yon.

Hindi ba WLO lang ang naka issue at the time vs GMA and FG? Hindi ba napigilan silang umalis kahit WLO lang?

Kung naka hold departure ka rin kahit WLO lang, ano pa kaya ang difference ng WLO sa tunay na HDO?

Ngayon, hindi na puwedeng mag issue ang DOJ ng Hold departure or Watch list. Kaya ang sabi ni De Lima, hindi na sila puwedeng pumigil ng departure:

Kung bawal ang Watch list kasi walang authority ang DOJ na pumigil ng departure, hindi puwedeng ang sumunod na nangyari ay naglabas ang DOJ ng Lookout na puwede ring pumigil ng departure. Kasi magiging contempt yon, na ang lumalabas ay ayaw nilang sumunod sa SC.

Therefore, ang tamang interpretation, ang HDO at WLO ay parehong puwedeng pumigil ng departure, pero parehong hindi na puwede sa DOJ (judiciary na lang ang puwedeng mag-issue ng HDO). Ang nilalabas ng DOJ ngayon ay LBO, na hindi naman puwedeng pumigil ng departure.

HDO can and shall prevent you from leaving legally. That's why its called as such. It hold's your departure. This is valid, this is existing.

WLO and LBO are the same, though they (the issuing authority) will not admit this. They have the same effects, they are of the same specie, but with a different name. The DOJ can no longer issue a WLO. To answer this, they created the LBO. This is maybe what your immigration friends are saying. However, it just simply takes note that you are leaving, your flight itinerary and inform the authorities, among others. However, it cannot "legally speaking" prevent you from leaving like a HDO. But, then again, it doesn't mean that you wont be able to miss your flight. What they will do is simply delay you in boarding until you miss your flight.
