I really don't understand why Illegal Detention was charged to Cedric's group for mauling Vhong Navarro when it was clear that there was no intention by the group to detain him after beating him up inside the condo unit as he was immediately turned over to the Taguig police for blotter.
Non bailable offense charged to the group?
Again I still dont understand coz it's just a case of mauling or beating up someone over a girl and again there was no intention to murder or kill the victim but rather just teach him a lesson not to fool around with somebody's GF.

This case is clearly politically motivated and bias.
There are too many heinous crimes in the country to solve and the authorities take this mauling issue with too much attention.

Honestly this case is just an ordinary case which can just be settled by a Barangay Chairman and not involve the entire country's police force to feast upon.

I'm no fan of Vhong (far from it), but the guy was CLEARLY setup ...... this is CLEARLY not just a simple case of beating someone up over a girl ...... CLEAR-AS-DAY premeditated crime by Cedric amd his gang.

AFAIK serious illegal detention doesnt have to take a significant amount of time ...... the fact that one is held against his will (plus other conditions) would be sufficient for the charge.

Nasa Revised Penal Code, Art. 267, madali lang namang intindihin:

Art. 267. Kidnapping and serious illegal detention. — Any private individual who shall kidnap or detain another, or in any other manner deprive him of his liberty, shall suffer the penalty of reclusion perpetua to death:

1. If the kidnapping or detention shall have lasted more than five days.
2. If it shall have been committed simulating public authority.
3. If any serious physical injuries shall have been inflicted upon the person kidnapped or detained; or if threats to kill him shall have been made.
4. If the person kidnapped or detained shall be a minor, female or a public officer.

The penalty shall be death where the kidnapping or detention was committed for the purpose of extorting ransom from the victim or any other person, even if none of the circumstances above-mentioned were present in the commission of the offense.

Notes:

- Lawyers call it "Serious Illegal Detention," not just "Illegal Detention," kasi may Serious Illegal Detention at may Slight Illegal Detention.   

- How long ang detention? Under paragraph 1, pag more than 5 days ang period of detention, serious illegal detention na.

- But if any of the circumstances under the succeding paragraphs is present, serious illegal detention kahit less than 5 days detention.

- For example, if the victim is a female, hindi kailangan 5 days.  Sandaling detention lang, serious illegal detention na, because of paragraph 4.

- Sa kaso ni Vhong, saan nangyari ang serious illegal detention?   Simula sa loob ng condo hanggang makarating ng presinto.  As long as Vhong was not free to go where he wanted to go, considered "detained" siya. 

- Walang 5 days ang detention niya, bakit serious illegal detention?  Because of paragraph 3 --- kasi may serious physical injuries. 

- Bakit no bail?  Kasi non-bailable pag ang penalty ay reclusion perpetua or higher.  Ano penalty?  Reclusion perpetua to death (wala na tayong death penalty, so reclusion perpetua lang).  Kaya non-bailable.

- Ganyang kabigat talaga ang kasong Serious Illegal Detention.  Talo pa ang homicide, punishable by reclusion temporal and bailable.

So long as hindi sya officially mag sabi ng pangalan, it really doesn't mean anything to this point. Takot din yan masampahan ng libel case. I read an article that she was really drunk at that point. I'm not raising Vong's flag here or anything but really, these girls coming out, claiming they were raped YEARS ago is really getting old.

1. If you felt that you were raped, why wait for years.
2. Name drop that sh!t so the law can do something about it instead of blabbering it with Mo. Jesus, Mo twister? Really?

I don't wanna say bad things about Kat, because I met her a few times sa mga sneaker event, she seems like a nice person, but really, this whole thing about rape is getting old.
